Domain wars
I decided to take the leap of faith and send the person who wants to sell her domain a check. I wrote this:
From: Me
To:: Her
I just dropped a check in the mail to your address below. Let me
know when you receive it.
Once you're satisfied with the money, I will tell my domain hosting
company to transfer it over to me. You will have to confirm with
your hosting company that you're transferring away from them. Than
should take care of it.
Let me know when you receive the check, and I'll start the transfer.
I documented clearly on the check, what it was for. This isn’t too legally binding, but it does give me a little bit of leverage. Probably foolish, but I don’t feel like explaining to her how to set up a paypal account or deal with ebay.
I got this yesterday:
From: Her
To: Me
I heard that there is continuing liability for what the domain does,
do you have any legal information related to language of written
agreement that it is transferred. Also if you ever decide not to
continue it, I would like the agreement that for the same amount you
paid, we can have first option to buy it back from you at that time,
if ever. thanks.
So I said this:
From: me
To: Her
Please do not deposit my check until you are completely comfortable with our arrangement. Cashing the check will indicate to me that it you've sold the domain and I've bought it.
I'm going to be traveling for the next week, and I don't have time to research this right now. Your registry company are the ones to ask for the legal details. I'm sure they've dealt with this before.
If you need some sort of written agreement beyond this email, I'll be happy to write it up and sign it when I get back. The other option is that you could send me the language you need, and I'll review, print and sign it if I agree with it.
- I will assume full responsibility for all aspects of the domain as soon as it's transferred to me.
- If I decide that I want to sell the domain, you will have first option to buy it back. I will contact you at this email address if that's the case.
Let me know what you learn from your domain registry company.
We may yet need thugs.
